Grievance & discipline

Whether you have a grievance you want presented in the most effective way or you want support defending yourself in the course of a disciplinary process, we can help. We use our experience acting for employers to navigate procedures to your best advantage and can advise on the possibility of constructive dismissal where an employer’s failures amount to a breach of your employment contract.

Non-compete clauses, post-termination restrictions

Are you are leaving your current role and want to check the enforceability of existing covenants in light of an offer? Perhaps you would like a review of the covenants in your new contract before you sign? We can advise in both these scenarios, including advising on a strategy to negotiate your way out of restrictive covenants, or even better, to avoid entering into them in the first place.

Whistleblowing

Doing the right thing, and then being punished for it, is not acceptable. There is a strong legal framework to protect whistleblowers and we can help you navigate it. That includes how and when to blow the whistle through to litigating claims where you have been treated badly because you held your employer to account.

Contracts of employment

Many people assume that employment contracts are all pretty much the same, or that they are the employer’s standard form not capable of being negotiated. That’s not always the case. The time to ensure your contract guarantees you the best possible deal across the board – perhaps in terms of bonus, commission, post-termination restrictions, holiday entitlement or notice provisions – is before you sign it. We will highlight unusual or onerous provisions and help you negotiate a better foundation for your employment.

Dismissal & redundancy

Managing change

Whether the ‘change’ is a restructuring or reorganisation (which may or may not involve redundancies), TUPE outsourcing of a function or perhaps changing or harmonising terms and conditions of employment, we have substantial experience advising on all aspects of change management.  This means that we can assist employees to understand their rights in the face of an employer determined to make changes.

We understand that ending employment well is important: whether that means the best possible financial settlement, freedom from post-termination restrictions or just a fair and amicable parting of the ways, we will take time to understand your priorities, be realistic about what can be achieved and then negotiate hard on your behalf.

Tribunal claims

We have decades of experience litigating employment claims, acting for both employer and employee, right through to a final hearing. Our experience tells us that a decision to take your employer to a Tribunal requires a really careful weighing not only of your chances of winning, but also the likely financial, time and emotional cost.
